Contexte Charge Code Changes for New Law Enforcement Agency Distribution Category as of August 1, 2014

The Administrative Office of the Courts has identified charges under 27-101-205 for which the FINE amounts could potentially be disbursed to the Arkansas Game & Fish Commission in error for District Courts.  By law, these charges should have the FINE amount disbursed to the Law Enforcement Agency whose officer issues the citation.  That agency will be G&FC in most instances, but could also be the local police department, the county sheriff or the Arkansas State Police.  A listing of the specific charges being updated is included below.

 

To enable the proper distribution of monies to the correct agency, the AOC will be creating a new Fine Distribution Category of “LEA” to be used for these charges in District Courts.  In addition, four new Payable codes will be created and set up for each District Court to identify the agency receiving funds.  These will appear on the end-of-month CZRRCRG and CARCTGL reports:

 

PLEA - LEA ASP FINES

PLEG - LEA GFC FINES

PLEP - LEA CITY POLICE FINES

PLES - LEA SHERIFF FINES

 

In addition to the changes in distribution rules, the Description of each of these affected charges will be altered slightly in Contexte.  The 27-101-205 code section has to do with watercraft-related violations, so the word “WATERCRAFT” is being pre-pended to the existing charge Description.  As an example, the 27-101-205(f)(1) code description “LEAVING THE SCENE OF AN ACCIDENT” will change to “WATERCRAFT - LEAVING THE SCENE OF AN ACCIDENT”.  This will help distinguish these watercraft-related violations from other similarly worded ones, such as 27-50-302(5) - LEAVING SCENE OF ACCIDENT INVOLVING PROPERTY DAMAGE ONLY.
