ROGER DALE CAMPBELL

Petitioner

v.

HONORABLE JOHN PUTMAN,

JUDGE

Respondent

CR 03-1298

PRO SE MOTION FOR RECONSIDERATION OF PETITION FOR WRIT OF MANDAMUS [CIRCUIT COURT OF BOONE COUNTY, NO. CR 2001-433]

MOTION DENIED

Per Curiam

Roger Dale Campbell filed a petition for writ of mandamus in this court contending that the Honorable John Putman, Circuit Judge, had failed to act on a motion to dismiss charges he had filed in the Circuit Court of Boone County on December 4, 2002. On December 1, 2003, Judge Putman entered an order disposing of the motion. As the motion had been acted on by the respondent, we declared the petition for writ of mandamus to be moot. Campbell v. Putman, CR 03-1298 (Ark. January 8, 2004). Petitioner Campbell now asks that this court reconsider the matter and grant the mandamus petition.

The motion for reconsideration is denied. The basis of petitioner's request for reconsideration is unclear. It will suffice to say that he has not demonstrated that the respondent has failed to act on the pleading which was the subject of the mandamus action. Accordingly, there is no ground to reconsider the mandamus petition.

Motion denied.
