Jimmie Dyas lodged an appeal in this court from an order that denied a petition pursuant to Ark. Code Ann.§ 16-90-111 (Supp. 1995) to correct a sentence of life imprisonment without parole that was imposed on him in 1975. He now asks by verified motion that the appeal be dismissed on the ground that the petition filed in the trial court was untimely filed and thus he was procedurally barred from proceeding under the statute.

Motion granted.
