ALVIN AKINS

Appellant

v.

STATE OF ARKANSAS

Appellee

CR 03-1234

PRO SE MOTION FOR APPOINTMENT OF COUNSEL AND PETITION FOR WRIT OF CERTIORARI [CIRCUIT COURT OF JEFFERSON COUNTY, NO. CR 2003-239-5, HON. FRED DAVIS III, JUDGE]

MOTION AND PETITION GRANTED

Per Curiam

On July 31, 2003, judgment was entered reflecting that Alvin Akins had been found guilty by a jury of aggravated robbery, aggravated assault, theft of property and the offense of being a felon in possession of a firearm. An aggregate sentence of 216 months' imprisonment was imposed. The retained attorney who represented Akins at trial was relieved as counsel, and Akins filed a timely pro se notice of appeal.

Akins has filed a partial appeal record here and now seeks to have counsel appointed to represent him. He further asks that a petition for writ of certiorari be issued to have the remainder of the trial record brought up at public expense. Appellant has appended to the motion for appointment of counsel an affidavit of indigency in which he claims to have no assets beyond $6.40 in the inmate account where he is incarcerated. The appellee has not responded to the assertion of indigency,

As the appellee has not challenged appellant's claim that he is indigent, we will accept his contention that he is unable to afford the cost of the appeal. A writ of certiorari is issued returnable in thirty days to bring up the remainder of the record. Attorney Denita Moak is appointed to represent appellant in the appeal.

Motion and petition granted.
