ARKANSAS SUPREME COURT
NOT DESIGNATED FOR PUBLICATION

BILLY MACK NICHOLS, JR.
Appellant
v.
LARRY NORRIS, DIRECTOR, ARKANSAS DEPARTMENT OF CORRECTION
Appellee
03-277
PRO SE MOTIONS FOR EXTENSION OF TIME TO FILE APPELLANT'S BRIEF AND FOR COPY OF SUPPLEMENTAL RECORD [CIRCUIT COURT OF JEFFERSON COUNTY, NO. CIV 2001-12-2-3]
MOTION FOR EXTENSION OF TIME GRANTED, MOTION FOR COPY OF SUPPLEMENTAL RECORD MOOT
Per Curiam
Billy Mack Nichols, Jr., who is incarcerated in the Arkansas Department of Correction, filed a petition for declaratory judgment against the director of the department. The circuit court dismissed the petition, and the record on appeal from the order has been lodged here.
Appellant, proceeding pro se, seeks an extension of time to file the appellant's brief. He also requests a copy of the supplemental record lodged in the appeal on October 9, 2003.
The supplemental record consisted of an answer filed in the lower court by the appellee and a response to the answer.
After the motions were filed, appellant submitted the appellant's brief. As he has submitted the brief and does not contend in the motion for a copy of the supplemental record that the two documents are necessary to preparing the brief, the motion for a copy of the supplemental record is moot. The motion for extension of time is granted. Our clerk is directed to file the tendered brief as of the date of this opinion.
Motion for extension of time granted; motion for copy of supplemental record moot.
