Per Curiam

Melanie Freeman filed a petition for writ of mandamus in this court contending that the Honorable Michael Maggio, Circuit Judge, had failed to act on a motion for credit against her prison sentence for time spent in custody which she had filed in the Circuit Court of Faulkner County on July 30, 2003. On October 17, 2003, Judge Linda P. Collier acting in behalf of Judge Charles E. Clawson in whose court the motion was assigned entered an order disposing of the motion.

As the motion was not assigned to Judge Maggio's court and has been acted on by Judge Collier, the petition for writ of mandamus is moot.

Petition moot.
