APPEAL FROM THE CRAIGHEAD COUNTY CIRCUIT COURT
CR-2000-0945
HON. JOHN NELSON FOGLEMAN JUDGE
SHOW CAUSE ORDER ISSUED
Per Curiam
This case was originally submitted to this court on January 29, 2003. In an unpublished opinion dated February 12, 2003, we ordered rebriefing, with the appellant's brief due February 27, 2003. Appellant's counsel, R.S. McCullough, requested and received two extensions with his brief ultimately due on April 7, 2003. On April 7, 2003, Mr. McCullough filed a motion to be relieved as appellant's counsel. We denied the motion on May 21, 2003, and ordered counsel to file appellant's brief within thirty days. An amended order was entered on July 2, 2003, with appellant's brief due August 1, 2003. Mr. McCullough neither filed a brief nor requested an extension by August 1, 2003, and has not communicated with the court to this date. On September 22, 2003, appellant filed a pro se motion for new counsel. We granted the motion on September 30, 2003, and appointed William James to represent appellant. A new briefing schedule was set.
Accordingly, appellant's former attorney, R.S. McCullough, is ordered to appear on November 19, 2003, at 9:00 a.m. in the Supreme Court and Court of Appeals courtroom, Justice Building, 625 Marshall Street, Little Rock, Arkansas, and show cause why he should not be held in contempt for failing to comply with the July 2, 2003 order of this court.
