Mark R. Latta was found guilty of manufacturing a controlled substance and sentenced to fifteen years' imprisonment. The court of appeals affirmed. Latta v. State, CACR 00-910 (Ark. App. May 30, 2001). Latta subsequently filed in the trial court a timely petition pursuant to Criminal Procedure Rule 37 seeking to vacate the judgment. The petition was denied after a hearing, and the record on appeal from the order has been lodged here. Appellant Latta, who is in the custody of the Arkansas Department of Correction and proceeding pro se, now seeks an extension of time to file the appellant's brief and access to a copy of the transcript lodged in this appeal to prepare the brief. As an appellant must abstract that portion of the transcript pertinent to the appeal, the motion is granted. We direct our clerk to provide appellant with a copy of the transcript so that he may prepare his brief. The appellant's brief is due here no later than forty days from the date of this opinion.
