Appellee

CR 03-512

PRO SE PETITION FOR WRIT OF CERTIORARI, MOTIONS FOR ACCESS TO RECORD OF SENTENCING PROCEEDING AND FOR EXTENSION OF TIME TO FILE BRIEF, MOTION FOR EXTENSION OF TIME TO FILE BRIEF, AND MOTION TO DUPLICATE MOTIONS AT PUBLIC EXPENSE [CIRCUIT COURT OF MILLER COUNTY, NO. CR 98-568-2, HON. JIM HUDSON, JUDGE]

PETITION FOR WRIT OF CERTIORARI DENIED; MOTIONS MOOT

Per Curiam

In 1999, James Ken Anderson entered a plea guilty to murder in the second degree and was sentenced to 480 months' imprisonment. In 2002, Anderson filed in the trial court a petition for writ of habeas corpus pursuant to Act 1780 of 2001. The petition was denied by order entered February 7, 2003. On March 14, 2003, the trial court also denied a motion filed by Anderson asking that he be provided with a certified copy of the record designated on appeal from the February 7, 2003, order. Anderson has lodged an appeal in this court that encompasses both the February 7, 2003, and March 14, 2003, orders. Appellant, who is proceeding pro se, has filed a series of pleadings.

The first is a petition for writ of certiorari "to bring up the remainder" of the record. The petition must be denied because appellant has not specified what is missing from the record already lodged in the appeal.

Appellant also seeks access to the record of the sentencing proceeding in the trial court to prepare his brief, extensions of time to file the brief, and an order that his pro se motions to this court be duplicated at public expense. After the motions were filed, appellant filed his brief by the date it was due. As the brief has been filed, the motions pertaining to its preparation and tender are moot. The motion for duplication of the motions at public expense is also moot. The motions were filed without requiring further copies.

Petition for writ of certiorari denied; motions moot.
