WILLIAM FRANK JONES, JR.

Appellant

v.

ARKANSAS DEPARTMENT OF

CORRECTION, ET AL.

Appellees

02-412

APPEAL FROM THE CIRCUIT COURT OF JEFFERSON COUNTY, CR 2001-769-3, HONORABLE FRED D. DAVIS III, JUDGE

REBRIEFING ORDERED

Per Curiam

William Frank Jones, Jr., who is in the custody of the Arkansas Department of Correction (ADC) by virtue of multiple felony convictions, filed a civil rights action under 42 U.S.C. § 1983 in the Jefferson County Circuit Court. The circuit court dismissed the complaint, and Jones now contends that the circuit court erred in doing so. We cannot reach the merits of appellant's claim because his brief fails to comply with Supreme Court Rule 4-2.

Appellant's abstract consists of a list of the pleadings and documents that comprise the record on appeal, and his Addendum includes only the circuit court's order and an unidentified docket sheet. Although appellant correctly notes that Rule 4-2(A)(5) (2002) commands that pleadings and documentary evidence should not be abstracted, the Addendum to the appellant's brief shall include a copy of the order appealed from, "along with any other relevant pleadings, documents, or exhibits essential to an understanding of the case and the Court's jurisdiction on appeal." Ark. Sup. Ct. R. 4-2(a)(8) (2002). We note that the Addendum to appellant's brief does not include his complaint, the motion to dismiss, any relevant exhibits, or the notice of appeal. It is a practical impossibility for seven justices to examine a single transcript filed with this court, and we will not do so. E.g., City of Dover v. City of Russellville, 351 Ark. 557, 95 S.W.3d 808 (2003). Appellant has fifteen days from the date of this opinion to file a substituted abstract, Addendum, and brief to conform to Rule 4-2. If appellant fails to file a complying abstract, Addendum and brief within the prescribed time, the judgment or decree may be affirmed for noncompliance with the Rule. Ark. Sup. Ct. R. 4-2(b)(3) (2002).

Rebriefing Ordered.
