PETITION GRANTED
On October 10, 2002, appellant, Rufus A. Box, filed a petition for writ of certiorari, praying that a writ be granted directing court reporter to complete the transcript in this case. Box's attorney, David Mark Gunter, states that he filed a motion for belated appeal, which, according to our records was filed with the Arkansas Supreme Court on July 16, 2002, and granted September 5, 2002. On that date, the case was transferred to this court.
Gunter asserts that along with that motion, he lodged a partial record that did not contain the transcript. He asserts that while his motion referred to the reordering of the transcript, the record he lodged was not specifically described as a partial record. He further asserts that his brief was due October 15, 2002, that he has not yet received the transcript, and that he cannot prepare a brief without the transcript.
Although we are unable to determine whether a transcript has been ordered, we donote that the record is deficient in that regard. Therefore, the court reporter has 30 days to complete the transcript and the attorney of record has an additional 10 days to file the completed transcript with the clerk of this court. Appellant has also requested that a new briefing schedule begin after the transcript is lodged. We grant that motion as well.
