PRO SE MOTION TO SUPPLEMENT RECORD [CIRCUIT COURT OF JEFFERSON COUNTY, NO. CIV 99-223-2-3]

MOTION DENIED

Walter Urquhart, who is in the custody of the Arkansas Department of Correction (ADC) by virtue of multiple felony convictions, filed a petition for declaratory judgment against the director of the ADC, alleging that his parole eligibility date has been miscalculated by the ADC. The petition was denied, and the record has been lodged here on appeal. In the instant motion appellant Urquhart seeks to have the record supplemented with a copy of three criminal judgments that were entered against him in 1994 and 1995.

Appellant does not explain what significance the judgments have to this appeal. Moreover, he does not contend that the lower court relied on the judgments in making its decision. A record on appeal is confined to the pleadings and other material filed in the lower court that was material to the matter before the court. Appellant has not shown that the record in this appeal should be supplemented.

Motion denied.
