Duke v. State (Neal, J.) CACR01-967

Evidence -- Appellant's dogs had history of attacking without provocation; substantial evidence existed that appellant acted recklessly; finding of serious physical injury supported by substantial evidence; dogs clearly capable of causing death or serious physical injury; fact-finder could have reasonably inferred that dogs were used in such manner as to constitute deadly weapons; conviction for battery in second degree affirmed.
